Terms and Conditions of Service

1. Scope of Application

These Terms and Conditions apply to all business relationships between GARAGE MISCHEL S.À R.L. and its customers.

2. Contract Formation

Contracts are formed through the customer's order placement and our acceptance thereof. Quotations are non-binding.

3. Services

3.1 Repairs and Services

• Vehicle repairs of all types
• Maintenance work
• Sale of machinery and equipment for gardening and forestry
• Agricultural machinery service

3.2 Warranty

For repairs, we provide 12 months warranty on materials and workmanship. For sold new parts, manufacturer warranties apply.

4. Prices and Payment

4.1 Prices

All prices include statutory VAT at the applicable rate.

4.2 Payment Terms

• Invoices are payable within 30 days without deduction
• In case of payment delay, we charge default interest
• We reserve title until full payment

5. Liability

5.1 Limitation of Liability

We are only liable in cases of intent and gross negligence. Liability for slight negligence is excluded, except where essential contractual obligations are violated.

5.2 Safekeeping

Vehicles and objects are only safeguarded against dangers covered by our operational security measures.

6. Retention of Title

Delivered goods remain our property until full payment.

7. Termination/Withdrawal

In case of significant defects that cannot be remedied, the customer has a right of withdrawal.

8. Final Provisions

8.1 Applicable Law

Luxembourg law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

8.2 Jurisdiction

The competent jurisdiction is Luxembourg.

8.3 Severability Clause

Should individual provisions prove ineffective, the effectiveness of the remaining provisions remains unaffected.
